“No veo muchas complicaciones con los toar”: interrogando las limitaciones y potencialidades del enfoque restaurativo de la justicia transicional en Colombia.

Abstract
Mediante un estudio etnográfico sobre los Trabajos, Obras o Actividades con Contenido Reparador-Restaurador (TOAR), el artículo explora las limitaciones y potencialidades que conllevan su construcción y concreción entre las víctimas del Pueblo Nasa del territorio ancestral Sa’th Tama Kiwe, Caldono en el departamento de Cauca y la Jurisdicción Especial para la Paz (JEP) en el marco del macrocaso territorial 05. Los TOAR se constituyen en uno de los mecanismos de reparación que deben realizar los comparecientes para ser beneficiarios de sanciones propias, asumiendo responsabilidad por crímenes y aportando verdad plena sobre hechos y conductas contra víctimas en el marco del conflicto armado interno. La JEP, componente de justicia del Sistema Integral de Paz creado en el punto cinco del Acuerdo de Paz firmado entre el Estado colombiano, durante el gobierno de Juan Manuel Santos y las FARC-EP en el 2016, tiene la función de administrar justicia transicional con enfoque restaurativo. El artículo argumenta la complejidad en la construcción de estos proyectos reparadores dado los diferentes puntos de partida y posiciones de los actores comprometidos. A su vez, el contenido reparador y restaurador podría representar una paradoja para las víctimas Nasa acreditadas al no poderse avanzar en el restablecimiento de la armonía y el equilibrio lo que es para JEP, no poder aportar a la reparación transformadora que promueve la justicia transicional restaurativa en Colombia. El articulo también pretende ofrecer algunas reflexiones sobre la construcción colectiva de los TOAR mediante un diálogo intercultural que podría ser un camino que aporte para su materialización. Para el desarrollo de este trabajo se recurrió a la metodología cualitativa con apoyo de técnicas como la observación participante, la conversa, las entrevistas y el análisis documental.

Through an ethnographic study on Works, Works or Activities with Reparative-Restorative Content (TOAR), the article explores the limitations and potentialities that their construction and realization entail among the victims of the Nasa People of the ancestral territory Sa'th Tama Kiwe, Caldono in the department of Cauca and the Special Jurisdiction for Peace (JEP) within the framework of the territorial macrocase 05. The TOAR constitute one of the reparation mechanisms that the appearing parties must carry out. to be beneficiaries of their own sanctions, assuming responsibility for crimes and providing full truth about facts and conduct against victims within the framework of the internal armed conflict. The JEP, justice component of the Comprehensive Peace System created in point five of the Peace Agreement signed between the Colombian State, during the government of Juan Manuel Santos and the FARC-EP in 2016, It has the function of administering transitional justice with a restorative approach. The article argues the complexity in the construction of these reparative projects given the different starting points and positions of the committed actors. At the same time, the reparative and restorative content could represent a paradox for accredited Nasa victims as they cannot make progress in reestablishing harmony and balance, which is, for JEP, not being able to contribute to the transformative reparation that promotes restorative transitional justice in Colombia. The article also aims to offer some reflections on the collective construction of the TOAR through an intercultural dialogue that could be a path that contributes to its materialization. To develop this work, qualitative methodology was used with the support of techniques such as participant observation, conversations, interviews and documentary analysis.
