dc.descriptionLa teoría sobre el origen del ordenamiento jurídico se ha esforzado en distinguir el origen político del legislador del producto que este cuerpo crea, esto es, el derecho. Entendiéndolo como un cuerpo de creación del derecho, la teoría política de la Constitución permite caracterizar al poder constituyente como el producto de un proceso político de conformación social que es creado para organizar e instituir al Estado, mientras que la Constitución y todo el derecho son los instrumentos de esa ordenación que, una vez creados, subsisten y se explican por sí mismos.es-ES
