Abstract
El Derecho Internacional al ser el sistema regulatorio de las interacciones entre sujetos pertenecientes al mismo, se mantiene en constante desarrollo y evolución. En ese sentido y atendiendo a las necesidades actuales que apuntan al cuidado y preservación del medio ambiente y el escenario jurídico nublado respecto a la existencia de obligaciones internacionales efectivas sobre su protección, resulta necesario indagar sobre las contribuciones de la Corte Internacional de Justicia, a través de su jurisprudencia, para promover la consolidación de una responsabilidad erga omnes de los Estados en la protección del medio ambiente. Producto del análisis, parece pertinente asegurar la posibilidad de la estructuración de la obligación de protección al medio ambiente como una obligación de carácter erga omnes. Sin embargo, se presentan varias reflexiones acerca de su eficacia en la práctica y cómo el alcance de su efectividad depende de ajustes estructurales que, de no presentarse, limitan su objetivo final.

The International Law as the regulatory system of interactions amongst different subjects, is continuously in development. In that sense and addressing the current needs in regards of the preservation and care of the environment, this paper aims to investigate the contributions of the International Court of Justice, through its jurisprudence, in the consolidation of an Erga Omnes responsibility of the States in the protection of the environment. As a result of the analysis, it seems pertinent to ensure the possibility of structuring the obligation of protection of the environment as an Erga Omnes accountability. Nevertheless, several reflections have arose evaluating its effectiveness in practice and how the scope of its effectiveness depends on structural adjustments, which if not presented, limit its final objective.
