Abstract
A lo largo del presente trabajo se establecen conceptos, características, derechos y obligaciones que sirven como fundamento para la construcción de argumentos, que permiten responder a la pregunta de por qué es necesario regular el contrato de maternidad subrogada en Colombia desde la teoría del negocio jurídico. Se exponen los antecedentes científicos que rodean esta TRHA, las partes involucradas en el contrato y el vacío jurídico de salvaguarda para obtener el derecho de filiación, teniendo en cuenta lo manifestado por la Corte Constitucional en la sentencia T - 968 de 2009. Además, se acude a la revisión de los ordenamientos jurídicos de Reino Unido y el Estado de California en Estados Unidos, con el objetivo de tener una visión más amplia sobre el desarrollo de esta técnica, y en consecuencia ser referentes para el vacío jurídico que existe en Colombia.

Throughout this document, concepts, characteristics, rights and obligations are established, which serve as a basis for the construction of arguments that allow answering the question of why it is necessary to regulate the surrogacy contract in Colombia from the theory of the legal business. The scientific background surrounding this AHRT, the parties involved in the contract and the legal vacuum of safeguard to obtain the right of filiation are exposed, this taking into account what was stated by the Constitutional Court in the sentence T - 968 of 2009. In addition, the legal systems of the United Kingdom and the State of California in the United States are reviewed, with the objective of having a broader vision of the development of this technique, and consequently being a reference for the legal vacuum that exists in Colombia.
