dc.description.abstractEl presente Trabajo de Grado es producto de la investigación realizada en torno a los grandes cambios y acontecimientos legislativos y jurisprudenciales que se han presentado en Colombia a partir de la protección especial de los derechos y las garantías de la mujer gestante y lactante, a través de la Estabilidad Laboral Reforzada por el Fuero de Maternidad. Dentro de este se contextualizará al lector sobre los antecedentes históricos que contribuyeron al progreso y protección de la mujer gestante y lactante, partiendo de los principios, derechos, garantías, legislaciones y pronunciamientos jurisprudenciales que protegen a la mujer antes, durante y después de dar a luz. De esta forma, en el primer capítulo de la presente investigación, se ahondará sobre las garantías y la protección a la maternidad para las mujeres colombianas que se encuentren en un proceso de contratación laboral. Posteriormente, en el segundo capítulo se estudiarán las garantías que tiene la mujer colombiana gestante o lactante durante la vigencia de un contrato laboral, entendiéndose todas las modalidades de contratación vigente en Colombia. Finalmente, el tercer capítulo comprende un breve recorrido histórico legislativo y jurisprudencial partiendo de la Ley 129 de 1931 hasta la Ley 2114 de 2021, reconociendo así el gran avance en la protección y garantía de la mujer al aumentar el tiempo de la licencia de maternidad, y el establecimiento de la Licencia Parental Compartida, la cual permite que ambos padres puedan gozar de esta garantía y protección al momento del nacimiento de su hijo.spa
dc.description.abstractThis thesis is the result of research conducted on the major legislative and jurisprudential changes and developments that have occurred in Colombia since the special protection of the rights and guarantees of pregnant and nursing women through the Reinforced Employment Stability through Maternity Protection. This chapter will contextualize the reader´s understanding of the historical background that contributed to the progress and protection of pregnant and breastfeeding women, based on the principles, rights, guarantees, legislation, and jurisprudential rulings that protect women before, during, and after giving birth. Thus, the first chapter of this research will delve into the maternity guarantees and protections for Colombian women undergoing employment contracts. The second chapter will subsequently examine the guarantees available to pregnant or breastfeeding Colombian women during the term of an employment contract, covering all the current employment modalities in Colombia. Within this chapter, the reader will be contextualized regarding the historical background that contributed to the progress and protection of pregnant and breastfeeding women, based on the principles, rights, guarantees, legislation, and jurisprudential rulings that protect women before during, and after giving birth. Thus, the first chapter of this research will delve into the guarantees and protection of maternity for Colombian women undergoing employment contracts. Finally, the third chapter provides a brief historical overview of legislation and jurisprudence, beginning with Law 129 of 1931 and continuing through Law 2114 of 2021. This chapter recognizes the significant progress made in protecting and safeguarding women through the extension of maternity leave and the establishment of Shared Parental Leave, which allows both parents to enjoy this guarantee and protection at the time of their child’s birth.eng
