dc.description.abstractEn el presente trabajo se estudia la figura del abanderamiento de naves como elemento clave para fortalecer la Marina Mercante colombiana, y se analiza el marco normativo que regula el régimen administrativo de naves y artefactos navales de bandera colombiana. Igualmente, las cuestiones que deben ser objeto de una regulación de fondo y la importancia que esta aportaría al desarrollo económico del país. El desarrollo de este trabajo se plantea a partir de comprender el concepto integral de la expresión “Marina Mercante” y a partir de allí se realiza un estudio del marco legal vigente que regula los diferentes elementos que hacen parte de la Marina Mercante en Colombia, luego se referirá a los organismos especiales de las Naciones unidas (OMI y OIT) y, finalmente, se analizaran algunas situaciones que deben regularse en paralelo relacionadas al fortalecimiento de la Marina Mercante.
dc.description.abstractengIn this paper, the figure of the flagging of ships is studied as a key element to strengthen the Colombian Merchant Marine, and the normative framework that regulates the administrative regime of ships and naval artifacts of the Colombian flag is analyzed. Likewise, the issues that should be subject to substantive regulation and the importance that this would contribute to the economic development of the country. The development of this work is based on an understanding the integral concept of the expression "Merchant Marine" and from there a study of the current legal framework that regulates the different elements that are part of the Merchant Marine in Colombia is carried out, then the special organizations of the United Nations (IMO and ILO) will be referred to and, finally, some situations that should be regulated in parallel related to the strengthening of the Merchant Marine will be analyzed.
