dc.description.abstractElaboración de Caso Difícil en Contextos Globalizados Arbitraje de Inversiones entre las sociedades EUROPLAST S.A. y OPTIPLAST S.A.S. vs. REPÚBLICA DE COLOMBIA que pretende (i) Determinar si en razón de la materia se considera que la demandante realizó una inversión en Colombia protegida en los términos del APPRI suscrito entre Colombia y España, y si el CIADI tiene jurisdicción para la resolución del presente conflicto Y (ii) Determinar si con las actuaciones del estado colombiano se actuó en contravención e incumplimiento del estándar de trato justo y equitativo, consagrado en el APPRI.
dc.description.abstractengPreparation of a Difficult Case in Globalized Contexts Investment Arbitration between the companies EUROPLAST S.A. and OPTIPLAST S.A.S. vs. REPUBLIC OF COLOMBIA that seeks to (i) Determine whether, based on the subject matter, the claimant is considered to have made an investment in Colombia protected under the terms of the BIT signed between Colombia and Spain, and whether the ICSID has jurisdiction to resolve this dispute, and (ii) Determine whether the actions of the Colombian state contravened and breached the standard of fair and equitable treatment enshrined in the BIT.
