dc.description.abstractEl texto es el resultado de una investigación que tuvo como objetivo analizar si el derecho a la objeción de conciencia en la aplicación de la eutanasia logra vulnerar el derecho a la dignidad humana del paciente, para cumplir con ese propósito se desarrolló una metodología cualitativa con un alcance descriptivo, retomando el método deductivo, se revisaron textos sobre el tema a nivel teórico, legal y jurisprudencial; la eutanasia y la objeción de conciencia se abordan desde la necesidad de comprender la naturaleza jurídica, teniendo en cuenta que involucra dos derechos fundamentales consagrados en la Constitución y las leyes, por un lado, el derecho a la vida y por el otro la objeción de conciencia. Al final se logra comprender que la aplicación del derecho a la vida no necesariamente está por encima de la objeción de conciencia cuando hay avances en el ordenamiento jurídico que proponen decisiones intermedias sin afectar a los pacientes que optan por la eutanasia.
dc.description.abstractengThe text is the result of an investigation that aimed to analyze whether the right to conscientious objection in the practice of euthanasia, manages to violate the right to human dignity of a patient. In order to fulfill this purpose, a qualitative methodology with a descriptive scope was developed. Returning to a deductive method, texts on the subject were reviewed at a theoretical, legal and jurisprudential level; Euthanasia and conscientious objection are approached from the need to understand the legal nature of two fundamental rights, embedded in the constitution and in law, on one hand the right to life and on the other, conscientious objection. In the end, it is possible to understand that the application of the right to life is not necessarily above conscientious objection as there are advances in the legal system that propose intermediate decisions without affecting patients who choose euthanasia.
