dc.description.abstractEl presente artículo de investigación tiene como propósito analizar la inclusión del enfoque de género en las sentencias judiciales en la ruta individual de restitución de tierras en el municipio de Santander de Quilichao, departamento del Cauca, a partir del marco general y político de la restitución de tierras, con el fin de verificar cómo se llevan a cabo esos procesos en que se les restablecen los derechos a las mujeres víctimas en el marco del conflicto armado. Asimismo, se hace un recorrido teórico que ayuda a contextualizar sobre la restitución de tierras, el enfoque de género y así llegar a la Ley 1448 de 2011, imprescindible en este campo investigativo. Acudiendo al enfoque cualitativo, se llevó a cabo un análisis a las sentencias judiciales que se profirieron en el marco de las solicitudes por parte de las víctimas en el municipio mencionado, permitiendo dar una perspectiva de los procesos al respecto del enfoque de género que de acuerdo a la ley se enmarcan dentro del enfoque diferencial, corroborando el amparo que brinda la ley al ordenamiento de organismos institucionales para garantizar la protección a mujeres, quienes abandonaron o fueron despojadas de sus tierras, para finalmente brindarles la protección y cuidado tal como lo establece el artículo 13 de la mencionada ley.
dc.description.abstractengThe purpose of this research article is to analyze the inclusion of the gender approach in judicial sentences in the individual route of land restitution in the municipality of Santander de Quilichao, department of Cauca, based on the general and political framework of land restitution, in order to verify how these processes are carried out in which the rights of women victims are restored in the framework of the armed conflict. Likewise, a theoretical journey is made that helps contextualize the concept of land restitution, the gender approach, in order to reach Law 1448 of 2011, essential in this research field. Using the qualitative approach, a look at the sentences of requests by the victims in the aforementioned municipality was carried out, allowing us to give a perspective of the processes regarding the gender approach that, according to the law, are framed within the differential approach, corroborating the protection that the law provides to the organization of institutional organizations to guarantee the protection of women heads of family, who due to harassment were dispossessed of their lands, to finally provide them with the protection and care as established in article 13 of the aforementioned law.
