dc.description.abstractDesde una perspectiva del pluralismo jurídico, el presente artículo aborda los límites de la autonomía étnica territorial existentes en el Consejo Comunitario de la Comunidad Negra del Río Naya. Sustentado en un análisis jurisprudencial y entrevistas semiestructuradas, se hace un recorrido sobre los orígenes de la referida entidad y su constitución como autoridad étnica. Así mismo, se identificaron determinados factores que restringen el ejercicio de la autonomía étnico territorial de este Consejo: La presencia de actores armados ilegales en el territorio; los conflictos derivados por la existencia de otras organizaciones y/o autoridades en el territorio; la deficiente coordinación y cooperación entre el Consejo Comunitario y el Estado; y los conflictos territoriales de carácter interétnico e intercultural. La relevancia y el problema de investigación de esta investigación consiste en vislumbrar los factores que limitan la autonomía con la finalidad de que el Estado adopte las medidas que permita el ejercicio real de la autonomía del Consejo.
dc.description.abstractengFrom a legal pluralism perspective, this article addresses the limits of territorial ethnic autonomy existing in the Community Council of the Black Community of the Naya River. Based on a jurisprudential analysis and semi-structured interviews, a review is made of the origins of this entity and its constitution as an ethnic authority. Likewise, certain factors were identified that restrict the exercise of the ethnic territorial autonomy of this Council: the presence of illegal armed actors in the territory; the conflicts derived from the existence of other organizations and/or authorities in the territory; the deficient coordination and cooperation between the Community Council and the State; and the territorial conflicts of interethnic and intercultural character. The relevance and the research problem of this investigation consists of glimpsing the factors that limit autonomy with the purpose of the State adopting measures that allow the real exercise of the Council's autonomy.
