dc.description.abstractLa presente investigación analiza la regulación de la mediación penal en Colombia, tomando como referencia el Manual de Justicia Restaurativa expedido por la Fiscalía General de la Nación mediante la Resolución 00383 de 2022 y su modificación en la Resolución 447 de 2023. El estudio identifica las fortalezas y debilidades de este instrumento, evaluando su coherencia normativa y su efectividad práctica en el contexto del Sistema Penal Oral Acusatorio. A partir de un enfoque cualitativo y un análisis documental, se comparan experiencias internacionales exitosas, como las de España, Canadá y Chile, con la situación colombiana. Los resultados muestran que, aunque el Manual constituye un avance importante, su implementación se ve limitada por la falta de capacitación homogénea de mediadores, la ausencia de protocolos especializados y la inexistencia de un sistema robusto de indicadores. Se concluye que la mediación penal, bien aplicada, es una herramienta legítima y eficaz para reducir la congestión judicial, garantizar la reparación integral de las víctimas y contribuir a la disminución de la reincidencia.spa
dc.description.abstractThis research analyzes the regulation of criminal mediation in Colombia, taking as a reference the Restorative Justice Manual issued by the Office of the Attorney General through Resolution 00383 of 2022 and its amendment in Resolution 447 of 2023. The study identifies the strengths and weaknesses of this instrument, assessing its regulatory coherence and practical effectiveness within the framework of the Accusatory Criminal System. Using a qualitative approach and documentary analysis, it compares successful international experiences —such as those of Spain, Canada, and Chile— with the Colombian context. The findings show that, although the Manual represents an important step forward, its implementation is limited by the lack of standardized mediator training, the absence of specialized protocols, and the nonexistence of a robust system of indicators. The study concludes that criminal mediation, when properly applied, is a legitimate and effective tool to reduce judicial congestion, ensure comprehensive victim reparation, and contribute to lowering recidivism.eng
