dc.description.abstract	En Colombia, el Estado ha sido objeto de reproche de responsabilidad médica a lo largo de la historia en cuanto se configuren los elementos que, desarrollados jurisprudencialmente, dan lugar a ello. Sin embargo, dicha imputación se realiza, categóricamente, de manera subjetiva, es decir cuando la afectación es producida en virtud de la actuación directa de un agente del Estado y no cuando se deriva de una falla del sistema. El presente escrito es la reflexión sobre la investigación de los títulos bajo los cuales se le imputa responsabilidad médica objetiva al Estado por fallas en el sistema de salud, en su calidad de garante, según se desprende de los artículos 365, 6 y 90 de la Constitución colombiana de 1991. Por esta razón, el análisis conceptual discurre en una triple perspectiva: como un derecho, un servicio público y un sistema. Lo anterior significa disertar sobre la tensión existente entre la prestación del servicio de la salud como un derecho individual y como un sistema.
dc.description.abstracteng	Historically, the State of Colombia has been object of criticism regarding medical liability, when the elements stablished by court decisions prompt to it. Nonetheless, said imputation has been done, categorically, in a subjective way. That means, when an affectation has been produced by direct action of a state agent and not when it comes from a system failure. This paper is a reflection on the imputation titles of the State’s objective medical liability due to failures in the health system. This, taking the State as a guarantor and according to articles 365, 6 and 90 of the 1991 Colombian’s constitution. Thus, the concept analysis develops in a three-way perspective: as a right, as a public service, and as a system. This opens a discussion about the tension between the provision of the health service as an individual right and the provision of the health service as a system.
