dc.description.abstractLa discusión sobre la consideración de la moralidad en los animales y del ejercicio de su titularidad sobre los derechos ha sido un debate ampliamente reconocido y desarrollado en los últimos años, en los diversos espacios académicos y científicos, y hoy en día cobra más vigencia en el panorama político global, al haberse reconocido numerosas problemáticas ambientales a gran escala, que admiten un impacto directo de la actividad antropogénica en el medio ambiente y sugieren la necesidad de replantear la relación intrínseca que tiene el ser humano con la naturaleza. Este problema con ocasión en el lenguaje, tiene origen en la concepción moral que imputamos a otros animales que no son humanos, a quienes les hemos atribuido el carácter de cosa y/o cosa sintiente, restándoles el valor que tienen por sí mismos, e instrumentalizándolos en muchas actividades humanas. Esto no solo modula la percepción, sino también la actitud moral de las personas frente a sus acciones, reproduciéndose dichas significaciones en nuestros sistemas jurídicos y legales, y así mismo en nuestras formas de investigar, de conocer y de actuar. Por ello, se hace necesario analizar los fundamentos éticos y jurídicos tradicionales que han sido determinantes en nuestra sociedad para regular y modular la interacción de las personas con la naturaleza y con los animales no humanos; así como las propuestas alternativas a estas consideraciones morales, que reivindican a los animales no humanos dentro del circulo moral y del ámbito de la justicia; y de esta manera considerar por qué debemos reconocer la titularidad en los animales como sujetos de una justicia política interespecífica y de derechos básicos.
dc.description.abstractengThe discussion about the consideration of morality in animals and their rights exercise has been a widely recognized and developed debate in recent years, in the various academic and scientific fields, and today it is more relevant in the global political scene, having recognized numerous environmental problems on a large scale, which admit a direct impact by the anthropogenic activity on the environment and suggest the need to rethink the intrinsic relationship that humans have with nature. This problematic with occasion in the language, has origin in the moral conception that we impute to other animals that are not human, to whom we have attributed the character of thing and / or sentient thing, subtracting them the value that they have by themselves, and instrumentalizing them in many human activities. This not only modulates the perception, but also the moral attitude of people in the face of their actions, reproducing those meanings in our legal and judicial systems, and likewise in our ways of investigating, knowing, and acting. By this reason, it is necessary to analyze the traditional ethical and legal foundations that have been decisive in our society to regulate and modulate the interaction of people with nature and with non-human animals; as well as the alternative proposals to these moral considerations, which vindicate non-human animals within the moral circle and the sphere of justice; and in this way consider why we should recognize the designation in animals as subjects of an interspecific political justice and basic rights.
