Abstract
Esta tesis analiza de forma integral cómo la regulación del mercado de gas natural en Colombia impacta la oferta y demanda del servicio público domiciliario, y cómo dicha dinámica incide en el fenómeno del desabastecimiento. A partir de una perspectiva jurídica, económica y regulatoria, se examinan las principales reformas normativas que han estructurado el sector, las fases contractuales del ciclo del gas desde la exploración hasta la comercialización, y las barreras que obstaculizan el funcionamiento eficiente y equitativo del mercado. El trabajo identifica un círculo vicioso entre oferta y demanda: la escasa disponibilidad del recurso desincentiva el consumo, mientras que la débil demanda no justifica nuevas inversiones en exploración y producción. A esto se suman problemas como la alta concentración del mercado en manos de Ecopetrol, la asimetría de información entre usuarios y reguladores, y la existencia de barreras jurídicas y regulatorias que dificultan el acceso, la competencia y la expansión de infraestructura. Finalmente, se concluye que la actual regulación estatal, liderada por la Comisión de Regulación de Energía y Gas (CREG), requiere una revisión estructural orientada a fomentar la transparencia, la inversión, la participación de nuevos agentes y la protección efectiva de los usuarios. Solo mediante una intervención más estratégica y menos restrictiva se podrá garantizar la seguridad energética y el desarrollo sostenible del mercado del gas natural en Colombia.

This thesis provides a comprehensive analysis of how the regulation of the natural gas market in Colombia impacts the supply and demand of the residential public service, and how this dynamic contributes to the phenomenon of supply shortages. From a legal, economic, and regulatory perspective, it examines the main legal reforms that have shaped the sector, the contractual phases of the gas cycle from exploration to commercialization and the barriers that hinder the efficient and equitable functioning of the market. The study identifies a vicious cycle between supply and demand: the limited availability of the resource discourages consumption, while weak demand does not justify new investments in exploration and production. Additional challenges include the high market concentration in the hands of Ecopetrol, the information asymmetry between users and regulators, and the presence of legal and regulatory barriers that restrict access, competition, and infrastructure expansion. Finally, it concludes that the current state regulation, led by the Energy and Gas Regulatory Commission (CREG), requires a structural reform aimed at promoting transparency, investment, the participation of new market agents, and the effective protection of users. Only through a more strategic and less restrictive intervention can energy security and the sustainable development of the natural gas market in Colombia be ensured.
