dc.description.abstractEl trabajo trae a colación el concepto del instrumento Jurídico, Acción de tutela, el objetivo, sus alcances Constitucionales, consecuencias de su incumplimiento. Posteriormente, vincular ese análisis con las acciones donde se invoca el derecho a la salud por omisiones, retardos de las EPS, por otro lado, el desconocimiento del juez al funcionamiento de nuestro sistema de salud que producen la vinculación directa en orden del fallo en cumplir con la prestación del servicio injustamente por falencias impropias y la posibilidad de que un precedente implique el crecimiento de recaer económicamente las IPS.
dc.description.abstractengThe work brings up the concept of the legal instrument, the tutela action, its objective, constitutional scope, and the consequences of non-compliance. Subsequently, it aims to link this analysis with actions invoking the right to health due to omissions or delays by the Health Promoting Entities (EPS). On the other hand, it addresses the judge's lack of understanding of the functioning of our healthcare system, which leads to direct orders in rulings requiring the unjust provision of services due to unrelated deficiencies and the potential for a precedent to increase the burden on Healthcare Provider Institutions (IPS).
