Abstract
Dada la creciente popularidad que han tenido las criptomonedas en los últimos años, la presente investigación tiene como fin analizar aspectos importantes de lo que representa este instrumento digital en nuestro país, así como también, indagar el marco regulatorio con el que se cuenta hasta el momento, esto considerando que estos activos contienen elementos especiales propios de su naturaleza, de ahí que se requieran conocimientos mucho más allá de lo jurídico para abordarlos y finalmente adoptar una norma que incluya forma de uso, manejo, control, supervisión, gestión ante los riesgos y protección al consumidor. Este estudio, se encargará entonces de recorrer desde el concepto de los criptoactivos hasta indagar el tema regulatorio desde diferentes enfoques con el objetivo de generar diferentes argumentos que permitan entender el impacto de las monedas digitales en Colombia y si existe la necesidad de regularlas

Given the growing popularity that cryptocurrencies have had in recent years, the purpose of this research is to analyze important aspects of what this digital instrument represents in our country, as well as to investigate the regulatory framework that is in place so far, considering that these assets contain special elements inherent to their nature, hence knowledge far beyond the legal is required to address them and finally adopt a standard that includes the form of use, handling, control, supervision, risk management and consumer protection. This study will then be responsible for going from the concept of crypto assets to investigating the regulatory issue from different approaches with the aim of generating different arguments that allow us to understand the impact of digital currencies in Colombia and whether there is a need to regulate them.
