dc.description.abstractEste documento analiza los riesgos potenciales ocasionados a raíz del fenómeno de la fragmentación del derecho internacional, el cual se deriva del constante surgimiento de diferentes sistemas internacionales, que muchas veces son independientes entre sí y tienen grandes diferencias, viéndose obligados a coexistir y ser aplicados de manera diferente. El fenómeno aquí mencionado ha producido consecuencias a nivel internacional, junto con una gran trascendencia jurídica acompañada del surgimiento de normas y la complejidad esta, siendo sistemas jurídicos o áreas de práctica jurídica especializadas que son relativamente autónomas. Así, el presente documento se enfoca en analizar las tensiones existentes entre el fenómeno de la fragmentación y la armonización del Derecho Internacional de conformidad con el caso Lhaka Honhat vs. Argentina, logrando así desenvolver aquellas asimetrías que surgen entre los Derechos de los pueblos Indígenas, el Derecho Ambiental y el Derecho Internacional de los Derechos Humanos. En ese sentido, busca encontrar la raíz de este problema en el marco del caso, que incluye las imperfecciones de las leyes internas, para así llegar a reflexionar en cómo la Corte Interamericana de Derechos Humanos a través de un proceso de unidad determina formas de armonización analizadas como fórmulas que conducen a la integración y por ende permiten la resolución de conflictos internacionales.
dc.description.abstractengThis thesis analyzes the potential risks caused by the fragmentation of international law, a result of the constant development of different international systems that vary widely and are independent of one another, which are forced to coexist and are implemented dissimilarly. This phenomenon has given rise to numerous consequences internationally as well as important legal repercussions worsened by the creation of laws and the complex nature of these, as they are relatively autonomous specialized legal systems or fields of law. By focusing on the existing tensions between the fragmentation and harmony within international law in accordance with the case of Lhaka Honhat vs. Argentina, this thesis will unravel the asymmetries among the rights of indigenous people, environmental law, and international human rights law. Accordingly searching for the root of this problem within the framework of the above case (including the imperfections of internal laws) in order to discover how the Inter-American Court of Human Rights through legal proceedings arrives at a harmonizing result, that can be used as formulas for integration that consequently allow a greater quantity of resolutions of international conflicts.as formulas that lead to integration and therefore allow a greater development of international conflicts.
