dc.description.abstractEl presente trabajo expone la controversia entre San JGeor S.A. de C.V., empresa mexicana del sector farmacéutico, y el Estado de Valtania, ante el Centro Internacional de Arreglo de Diferencias Relativas a Inversiones (CIADI). La disputa surge a raíz de la inversión de San JGeor en una zona afectada por el conflicto armado (ZOMAC), motivada por incentivos fiscales y garantías de seguridad otorgadas por el gobierno valtano. Sin embargo, el secuestro de su CEO, evidenció la falta de protección estatal, generando pérdidas económicas y la suspensión de operaciones. San JGeor demanda a Valtania por violación del Tratado Bilateral de Inversión (TBI) con México, alegando incumplimiento del estándar de protección y seguridad plena y reclamando compensaciones por daños financieros y morales. En su defensa, Valtania sostiene que cumplió con un estándar de diligencia razonable, argumentando que las condiciones de seguridad en las ZOMAC son estructuralmente limitadas. Además, impugna la jurisdicción del CIADI, alegando que el verdadero control de la inversión recae en una empresa sueca, lo que excluiría la aplicación del TBI. El caso plantea cuestiones fundamentales sobre la responsabilidad del Estado en la protección de inversiones extranjeras, la interpretación de los estándares de seguridad en tratados internacionales y la jurisdicción en disputas de inversión.
dc.description.abstractengThis work exposes the controversy between San JGeor S.A. de C.V., a Mexican company in the pharmaceutical sector, and the State of Valtania, before the International Center for Settlement of Investment Disputes (ICSID). The dispute arises as a result of San JGeor's investment in an area affected by the armed conflict (ZOMAC), motivated by tax incentives and security guarantees granted by the Valtano government. However, the kidnapping of its CEO showed the lack of state protection, generating economic losses and the suspension of operations. San JGeor sues Valtania for violation of the Bilateral Investment Treaty (BIT) with Mexico, alleging failure to comply with the full protection and security standard and demanding compensation for financial and moral damages. In his defense, Valtania maintains that he complied with a reasonable diligence standard, arguing that the security conditions in the ZOMAC are structurally limited. Furthermore, it challenges the jurisdiction of ICSID, alleging that the true control of the investment rests with a Swedish company, which would exclude the application of the BIT.
