dc.description.abstractAnálisis Jurídico en relación los casos en que los jueces condenen a las aseguradoras llamadas en garantía a pagarle la indemnización directamente a las víctimas. Los llamamientos en garantía se tratan de “demandas independientes” y debe ser juzgada únicamente la relación llameante-llamado. Por ende, al resolverse el llamamiento en garantía, y sabiendo que se trata de la acción del asegurado, el juez sólo podría ordenar a la aseguradora a reembolsar a su asegurado lo que pague en virtud de una condena.
dc.description.abstractengLegal analysis regarding cases where judges order insurers called in guarantee to pay compensation directly to victims. Calls in guarantee are considered "independent claims" and should only assess the relationship between the caller and the called party. Therefore, when resolving the third-party guarantee call, knowing that it involves the insured’s action, the judge may only order the insurer to reimburse the insured for amounts paid under a judgment.
