dc.description.abstractEl derecho fundamental a la salud es un derecho con gran importancia para los seres humanos, debido a que, tiene conexidad con derechos como la vida, la dignidad humana y la integridad física. Es por ello que, sus garantías primarias y secundarias son esenciales para una prestación adecuada del servicio de salud. Sin embargo, la aplicación de estas garantías se dificulta en contextos que tienen condiciones diferentes a las de los municipios o departamentos más cercanos al centro del país, siendo el departamento de Nariño uno de estos casos, donde se identifica que en un 59% de los municipios solo cuenta con una I.P.S que es del Estado, por lo que, no hay competencia entre prestadores de servicio de urgencia o de alta complejidad, y además el único prestador, no siempre cumple los requisitos necesarios para prestar el servicio por condiciones adversas que las convierte en zonas vulnerables, incumpliendo los fines esenciales del Estado, por lo que, ni la garantía primaria ni la secundaria logran evitar la vulneración del derecho, mostrándose al Estado como un prestador deficiente e inadecuado para la prestación de este servicio.
dc.description.abstractengThe fundamental right to health is a very important right for human beings, because it is connected to rights such as life, human dignity and physical integrity. For this reason, its primary and secondary guarantees are essential for an adequate provision of health services. However, the application of these guarantees is difficult in contexts that have different conditions than those of the municipalities or departments closest to the center of the country, with the department of Nariño being one of these cases, where it is identified that in 59% of the municipalities there is only one IPS that is from the State, so there is no competition between providers of emergency or highly complex services, and also the only provider does not always meet the necessary requirements to provide the service due to adverse conditions that make them vulnerable areas, failing to comply with the essential purposes of the State, so that neither the primary nor the secondary guarantee manage to avoid the violation of the right, showing the State as a deficient and inadequate provider for the provision of this service.
