dc.description.abstractEl objeto de la presente investigación está centrado en los problemas que afronta EMCALI por causa de las tomas irregulares de agua en sus redes matrices en zonas no reguladas, donde se encuentran ubicados Asentamientos Humanos Ilegales Precarios AHIP, lo cual genera un evidente daño patrimonial. El propósito fue proponer un mecanismo para mitigar el daño patrimonial en EMCALI causado por la toma irregular de agua en Asentamientos Humanos Ilegales Precarios - AHIP de Santiago de Cali. Se utilizó una metodología de tipo cualitativa con enfoque descriptivo, mediante revisión documental con perspectiva a textos normativos y oficiales. Se logró evidenciar la delicada situación social que reflejan los AHIP, el fuerte impacto que generan en el aspecto financiero con la toma irregular de agua; se reconoció el cuerpo normativo que se ha promulgado y sus resultados respecto a este fenómeno social; se corroboró la similitud tanto en la forma del fenómeno de los AHIP, como los cuerpos normativos para atenderlos en contextos internacionales similares a Santiago de Cali; se estableció la ruta normativa y técnica que permite crear una propuesta de solución a la problemática planteada. Por lo tanto, este fenómeno debe atenderse de una manera diferente, desde la visión social y buscando solucionar las causas raíces del problema, dado que los instrumentos de Ley promulgados se enfocan en atender las consecuencias del mismo.
dc.description.abstractengThe purpose of this investigation is to focus on the problems faced by EMCALI due to irregular water intakes in its main networks in unregulated areas, where precarious illegal human settlements - AHIP - are located, which generates evident patrimonial damage. The purpose was to propose mechanisms to mitigate the patrimonial damage in EMCALI caused by the irregular intake of water in precarious illegal human settlements in Santiago de Cali. A qualitative methodology with a descriptive approach was used, through a documentary review with a perspective of normative and official texts. It was possible to demonstrate the delicate social situation that the AHIPs reflect, the strong impact that they generate in the financial aspect with the irregular intake of water; The normative body that has been promulgated and its results regarding this social phenomenon were recognized; the similarity was corroborated both in the form of the AHIP phenomenon, as well as the regulatory bodies to attend to them in international contexts similar to Santiago de Cali; the normative and technical route was established that allows the creation of a proposal for a solution to the problem raised. Therefore, this phenomenon must be addressed in a different way, from a social perspective and seeking to solve the root causes of the problem, since the enacted legal instruments focus on addressing its consequences.
